Terms of Service

These Terms of Service (the Terms) govern your access to and use of the Composerie platform, websites and related services (the Service). By creating an account or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a business, you confirm that you are authorized to bind that business.

1. Definitions

  • Service — the Composerie platform and related websites, applications and APIs.
  • Merchant (“you”) — the business or individual that registers and uses the Service.
  • End customer — a shopper who personalizes products on a Merchant's store using the Service.
  • Content — designs, templates, images, text and other materials uploaded to or created with the Service.
  • Fulfillment partner — a third-party print or production provider that fulfills personalized orders.

2. Acceptance of Terms

By accessing or using the Service you accept these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

3. Description of the Service

Composerie is a product-personalization platform for e-commerce. It lets Merchants create customizable products, collect personalizations from their end customers, generate production-ready files, and connect to e-commerce platforms and fulfillment partners. We may add, change or remove features over time.

4. Account Registration

You must be at least 18 years old and provide accurate, complete information to register. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

5. Subscription & Fees

Paid plans are billed in advance on a recurring basis. Current plans, prices, transaction fees and any free trial or beta terms are shown on our pricing page and at the point of purchase. Where you install via a third-party marketplace (such as the Shopify App Store), billing may be handled through that marketplace under its terms.

  • Fees are exclusive of VAT and other applicable taxes unless stated otherwise.
  • Payments are processed by our payment provider; you authorize us to charge your selected payment method.
  • If a payment fails, we may suspend paid features after a reasonable grace period.
  • We may change prices with at least 30 days' notice; changes apply from your next billing cycle.
  • Except where required by law, fees already paid are non-refundable.

6. Intellectual Property & Content

You retain ownership of your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce and display your Content solely as needed to operate and improve the Service and to fulfill orders you initiate. We and our licensors retain all rights in the Service itself, including its software, design and trademarks.

7. Acceptable Use

You agree not to use the Service to:

  • Upload or create Content that infringes intellectual property, privacy or other rights
  • Upload unlawful, harmful, deceptive, defamatory or obscene material
  • Distribute malware or attempt to gain unauthorized access to the Service or other accounts
  • Interfere with, overload or disrupt the Service, or circumvent usage limits and security controls
  • Use automated means to access the Service except via documented APIs and within their limits
  • Use AI-assisted features to generate infringing, deceptive or otherwise prohibited Content

We may remove Content or suspend accounts that violate these Terms.

8. End-Customer Content & Responsibilities

You are responsible for your relationship with your end customers, including your own terms, privacy notices and handling of personalizations they submit. You must ensure you have the rights and permissions necessary for the Content processed through your store and that it complies with applicable law.

9. Third-Party Integrations

The Service connects with third-party platforms and fulfillment partners. Your use of those services is governed by their own terms and policies, and we are not responsible for their availability, acts or omissions. You authorize us to exchange data with the integrations you enable.

10. Service Availability

We strive to keep the Service available and reliable but do not guarantee uninterrupted operation. We may perform maintenance, and features may occasionally be unavailable. The Service is provided on an “as is” and “as available” basis, without warranties of any kind except those that cannot be excluded by law.

11. Data & Privacy

Our handling of personal data is described in our Privacy Policy. Where we process personal data on your behalf as a processor, a Data Processing Agreement is available on request.

12. Indemnification

You agree to indemnify and hold harmless Composerie and its personnel from claims, damages and expenses arising from your Content, your use of the Service, your products, or your breach of these Terms or applicable law.

13. Limitation of Liability

To the maximum extent permitted by law, Composerie shall not be liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total aggregate liability arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be excluded by law.

14. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you materially breach these Terms or where required by law. On termination, your right to use the Service ceases; we will make your data available for a limited period (generally 30 days) before deletion, except where we must retain it by law.

15. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules. The competent courts of Amsterdam, the Netherlands, shall have exclusive jurisdiction over disputes, subject to any mandatory consumer protections that may apply.

16. General

  • Severability — if any provision is held invalid, the remaining provisions remain in effect.
  • Force majeure — we are not liable for failures caused by events beyond our reasonable control.
  • Assignment — you may not assign these Terms without our consent; we may assign them in connection with a merger or sale.
  • Entire agreement — these Terms and the documents referenced in them are the entire agreement between us regarding the Service.

17. Changes to These Terms

We may update these Terms from time to time. For material changes we will provide notice — by email and/or within the Service — at least 30 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
